要旨

Abstract:Patents are given for any inventions, whether products or processes, in all fields of technology, provided that they are new, involve an inventive step and are capable of industrial application. A gene patent is a form of intellectual property given for a specific isolated gene or sequence that has been altered or which occurs naturally and also the processes and methods for obtaining and using it, or any combination of these. This study has been taken up with the objective to clarify the ambiguity regarding the patenting of genes, and how this process differs across the globe. Patents in genetic research are widely debated in various fields like social, ethical, religious, environmental, scientific and legal.
